Asbestos Surveys Now Mandatory for NY Projects

In September 2025, the New York State Department of Labor (NYSDOL) provided official clarification that all renovation, demolition, remodel, or repair work on buildings and structures in New York now requires an asbestos survey. This requirement is enforced under Industrial Code Rule 56 (12 NYCRR Part 56), emphasizing the importance of identifying asbestos before work begins to protect workers, residents, and the environment.

Critical Compliance Requirements:

  • Who Conducts the Survey: Only a New York State-certified Asbestos Inspector conducts the survey.

  • Survey Before Work: Conduct the asbestos survey prior to starting work.

  • Documentation: Submit a copy of the completed survey to both the local jurisdiction issuing the demolition permit and the local Asbestos Control Bureau District Office.

  • The Assumption Rule: Even if a building qualifies for an exemption (e.g., built after January 1, 1974), it must be assumed to contain asbestos and demolished as an asbestos project unless a survey documenting the absence of asbestos is provided.

  • No Exceptions: All demolitions, renovations, remodels, or repairs, regardless of construction date, must comply with NYCRR Part 56. This does not override federal EPA or OSHA requirements, which may also apply.

This clarification highlights that asbestos surveys are not optional and are a critical step in keeping projects safe and compliant.
